The LEBURGERWEEK.COM site is operated and hosted in Montreal, in the province of Quebec, Canada by Peoples Mover Technologies Inc. (hereinafter, "Burger Week"). If you are a visitor from abroad and you provide information about yourself, you agree that your personal information is transferred and hosted in Quebec and protected by the law in this province.

When you access, browse, or use this website or any of its features, you accept and agree to, without limitation or qualification, to the terms and conditions set forth below (the “Agreement”).

By accessing or using the Website, you are indicating your acknowledgment and acceptance of this Agreement and your consent to the Privacy Policy. Please read this Agreement and the Privacy Policy (accessible through this link) carefully.

MODIFICATIONS TO THIS AGREEMENT

We reserve the right to make modifications to any part of this Agreement. Modifications will take effect immediately when they are posted on the Website and by continuing to use the website after any modifications are posted, you are indicating your acceptance of and agreement to those modifications. For Québec consumers, modifications to this Agreement will enter into force 30 days after they are posted on the Website, or, in the case of existing customers, 30 days after their receipt of an email notification regarding such modifications.

GENERAL INFORMATION

This website is the official website of Burger Week. No other website claiming to represent Burger Week is authorized and Burger Week will not be liable in any manner whatsoever of such sites. The information contained in this website are provided for informational purposes only. For more information about the products offered on this site, please contact us directly.

Burger Week makes no warranty as to the longevity of the site and reserves the right to terminate at any time in its sole discretion and without notice. You acknowledge that Burger Week cannot be held responsible for any loss or inconvenience suffered by the termination of this site.

RESTAURANTS

The present section applies only to restaurants participating at the event organized by Burger Week (the "Restaurant"), notwithstanding anything to the contrary.

The Restaurant, when registering and at other times where disclosures are made to Burger Week, will have to share information, contact information as well as those of its contact-person with Burger Week. The Restaurant consents by the present that Burger Week may use this information for publicity as well as for the benefit of its partners and/or sponsors, who may thus contact the Restaurant to share promotions, partnerships and to sell their services.

At the Restaurant’s request, Burger Week will remove the Restaurant’s information out of its database, and if requested, from its partners/sponsors’ database.

The Restaurant, when registering, agrees to sell to Burger Week its burger offered during the time specified by Burger Week as their event start and finish, and Burger Week agrees to buy said burger for the purpose of resale to users of the LEBURGERWEEK.com site.

The Restaurant is responsible to collect the applicable sale taxes on the sale of its special burger to Burger Week and Burger Week is responsible to collect and remit the applicable sales taxes on the sale of the burger to the users.

Burger Week will prepare and send a report to each participating restaurant detailing each burger sold to Burger Week. The report will show the transaction date, the price before taxes, the amount of tax charged by tax type and the total amount payable by Burger Week. 

Burger Week will raise an invoice for itself (self-bill invoice). The invoice will account for the burgers sold and the taxes applied to them as per the report. 

Burger Week will pay the Restaurant for the burgers purchased plus applicable taxes. The Restaurant is responsible to remit the said taxes to the proper tax authority.

Each participating restaurant is responsible and agrees to provide its GST/HST and QST registration numbers to Burger Week.

COPYRIGHT

This Web Site and any content that is protected by copyright. No user of this site may not, without the written consent of Burger Week, reproduce, copy, publish, transmit, communicate or use in any manner the material, information or trademarks contained in this site.

Retransmission, copying, use, reproduction, distribution or publication of the content whether a photograph, audio or video documents, in whole or in part is prohibited without the prior written permission of Burger Week otherwise the user could be exposed to legal proceedings.

The names of companies, products, services and logos contained in LEBURGERWEEK.COM may be trademarks or registered trademarks of their respective owners and are protected accordingly. It is forbidden to use any trademark displayed on this website without the prior written permission of Burger Week or copyright holder of the trademark.

LINKS TO OTHER SITES

In order to provide users of this site the largest possible range of information, Burger Week must appeal to others. Burger Week assumes no liability and makes no warranties to the user about the current character or the accuracy of information from third parties. To create a user account to participate in Burger Week, to buy a service or product, it is possible for the user to connect through a third party site, including some social media sites such as, but not limited to, Facebook and Twitter. The conditions of use of these sites are required to known by the user.

Furthermore, the possible visit any site from the site of Burger Week does not constitute an endorsement by Burger Week content of that other site. Burger Week disclaims any liability with respect to these other sites and the information contained therein.

The user can know if it is still available on the website of Burger Week by checking the url address at the top of the screen.

USER ACCOUNT

To participate in certain activities of Burger Week, the user provides some information that entitle them to a user account. This user account is used to identify a single user, particularly in relation to its participation in the contest Burger Week on LEBURGERWEEK.COM.

LEBURGERWEEK.COM allows users to create a user account and use it to vote for their favorite Burgers.

You are solely responsible for managing your user account and password and for keeping your password confidential and for restricting access to your user account.

You agree that you are responsible for all activities that occur on your user account or through the use of your password by yourself or by other persons.

As a condition to your use of the website, you agree:

• To keep the information provided to us in your user accurate, current and complete;

• Not to impersonate or misrepresent your affiliation with any person or entity;

• Not to access, tamper with, or use any non-public areas of the website or any computer systems in connection therewith;

• Not to attempt to probe, scan, or test the vulnerability of the website or any related system or network or breach any security or authentication measures used in connection with the website and such systems and networks;

• Not to attempt to decipher, decompile, disassemble, or reverse engineer any of the software used to operate the website or provide the services offered on the website;

• Not to harm or threaten to harm other users in any way or interfere with, or attempt to interfere with, the access of any user, host or network, including without limitation, by sending a virus, overloading, flooding, spamming, or mail-bombing the website or any feature, link, email address or prompt in relation to the website or the provision of the services contemplated by the website;

• Not to use the website in an abusive way contrary to its intended use, to its documentation or to our reasonable instructions;

• Not to systematically retrieve data or other content from the website to create or compile, directly or indirectly, in single or multiple downloads, a collection, compilation, database, directory or the like, whether by manual methods, through the use of bots, crawlers, or spiders, or otherwise; and

• Not to infringe or otherwise violate third party intellectual property rights when using or accessing the website.

We will have the right to investigate and prosecute violations of any of the above, including without limitation possible infringement or violation of any intellectual property rights and possible security breaches, to the fullest extent of the law and to terminate your user account or terminate your use of the Website in the case of any breach. We may involve and cooperate with law enforcement authorities in prosecuting users who violate the present Agreement. You acknowledge that, although we have no obligation to monitor your access to or use of the website, we have the right to do so for the purpose of operating the services provided through the website, to ensure your compliance with the present Agreement, or to comply with applicable law or the order or requirement of a court, administrative agency, or other governmental body

COLLECTING POINTS

With your user account, you can collect points (the “Points”) by (a) engaging in different activities on the website or (b) purchasing points. 

1. Actions to collect points:

The user must be signed on to his user account when engaging in the above-mentioned activities in order to collect the Points. 

The user must connect their social media account to their leburgerweek.com user account order to collect points for using the hashtag #LeBurgerWeek on social media.

PURCHASE OF POINTS:

The user can also purchase points through the website. The user can buy 2 000 points for $20,00 (Canadian dollars) or 5 500 points for $50,00 (Canadian dollars). Purchase of points must be done on leburgerweek.com.  

Points, either collected through actions or bought, will be valid during Burger Week or other events hosted by Peoples Mover Technologies Inc. 

User can consult the balance of their Points by signing on their user account at leburgerweek.com.

EXCHANGING YOUR POINTS 

100 Points can be exchanged for a $1,00 (Canadian dollars) in participating restaurants of Le Burger Week by using the QR Code on the user account. 

BADGES FOR POINTS

Users can collect badges during Le Burger Week. Badges confer no benefits or rewards. 

SAFETY

Burger Week may engage third parties as Internet service providers to provide hosting services, storage and data retention. Burger Week and as a provider of third party internet services may be used for such purposes servers located in Canada or any other country. The personal information of an individual can be processed and stored in Canada or a foreign country, and the government, courts, tribunals or agencies of law enforcement in this country may obtain disclosure of personal information through the laws of such foreign country.

DISCLAIMER

Not applicable to Québec consumers - We do not warrant or represent that the content of the website is accurate, up-to-date or complete, nor that it does not infringe the rights of others. We are providing the website and its contents on an “as is” basis. We make no representations or warranties of any kind with respect to the website, its contents or any of the products or services supplied through the website. We do not represent or warrant that the website, the server that makes it available will be free of errors, viruses or defects. Your access and use of this website is subject to factors beyond our control. We do not warrant that the website will meet your requirements or that the service will be uninterrupted or timely.

DISPUTE

This agreement and this website are governed by the laws of Quebec. Any dispute will be submitted to the competent courts of the Province of Quebec, District of Montreal.

INDEMNIFICATION

The user agrees to indemnify, hold harmless and defend Burger Week, the officers, directors or employees for any misuse of this site or any breach of this Agreement.

MISCELLANEOUS 

If a particular provision of this Agreement is held to be invalid by a court of competent jurisdiction, the provision shall be deemed severed from the present Agreement and shall not affect the validity of the present Agreement as a whole.

The non-exercise by Burger Week of its rights shall in no way constitute a waiver for the future of this law or any provision of this Agreement.
